MasterFishing.bg Fishing shop operates this shop and website, including all related information, content, features, tools, products and services, to provide you the customer a selected shopping experience (“Services“). MasterFishing.bg | The fishing tackle store uses Shopify, which enables us to provide the Services.

All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to withdraw any product at any time and may limit the quantities of products we offer to any person, geographic region or jurisdiction as judged on a case-by-case basis.

SECTION 3 ORDERS
When you place an order, you make a purchase offer. MasterFishing.bg Fishing shop reserves the right to accept or refuse your order for any reason at its discretion. Your order has not been accepted until the MasterFishing.bg Fisherman's Shop has confirmed acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before sending it, as MasterFishing.bg Fishing shop may not be able to process cancellation requests after accepting the order. In the event that we do not accept, make a change or cancel an order, we will try to notify you by contacting you at the email address, billing address and/or phone number provided when you place the order.

You represent and warrant that your purchases are for your personal or household use, not for commercial resale or export.

SECTION 4 – PRICES AND INVOICING
Prices, discounts and promotions are subject to change without notice The price charged for a product or service will be the price valid at the time of placing the order and will be indicated in the order confirmation email. Unless explicitly stated otherwise, prices quoted do not include taxes, shipping, handling, customs or import fees.
Prices published in our online stores may differ from prices offered in physical stores or in online or other third-party operated stores. We may from time to time offer promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms and Conditions. If there is a conflict between the terms of a promotion and these Terms, the terms of the promotion will prevail.

SECTION 5 SENDING AND SUPPLY
We are not responsible for any delay in shipping and delivery. All delivery times are approximate only and are not guaranteed. We are not responsible for delays caused by carriers, customs processing or events beyond our control. Once we transfer the products to the carrier, ownership and risk of loss pass to you.

Our services, including but not limited to, all trademarks, trademarks, text, displays, images, graphics, product reviews, video and audio, as well as their design, selection and arrangement, are the property of MasterFishing.bg. copyright and other intellectual property laws of the United States and foreign countries.

All other names, logos, product and service names, designs and slogans in the Services are trademarks of their respective owners.

As part of the Services, you may be provided with access to third-party client tools that we neither monitor nor control nor use.

MasterFishing.bg. The fishery shop is based on the Shopify, which allows us to provide the Services to you. However, all the sales and purchases you make in our store are made directly with MasterFishing.bg. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and MasterFishing.bg. You hereby expressly release Shopify and Shopify subsidiaries from all claims, damages and liability arising out of or relating to your purchases and transactions with MasterFishing.bg.

14.4 Agents must: (i) in all HTTP/HTTPS requests indicate that the request is from an Agent and reveal the Agent's name by including the following in the query user agent string: “Agent/[Agent Name]“; (ii) not to disguise or mask that access, use or interactions are by an Agent, such as by (a) imitating human behavior and interaction patterns. (b) completing or circumventing CAPTCHA or measures designed to distinguish human use of a computer. (iii) to answer honestly any question or suggestion, aimed at determining whether interactions come from a human, or a computer; (iv) not to circumvent or otherwise avoid any measure designed to block, restrict, change, or control whether and how Agents access, use, or interact with the Services.

We may terminate this agreement or your access to the Services (or any part thereof) at our sole discretion at any time and without notice and you will remain responsible for all amounts due up to the date of termination inclusive.
The following sections will continue to apply after termination: Intellectual Property, Feedback, Termination, Disclaimer of Guarantees, Limitation of Liability, Indemnity, Separation of Clauses, Refusal, Integrity of Agreement, Transfer, Applicable Law, Privacy Policy and all other provisions, which by their nature should remain in force after termination.

WE do not warrant and do not state that the use of your country's services will be uninterrupted, timely, secure or error-free. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW A DISCLAIMER OF LIABILITY BY UNDERTAKING OR OTHER WARRANTY, SO THE OVERALL DISCLAIMER MAY NOT BE REPRESENTED TO YOU. 

SECTION 17 LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO CASE MasterFishing.bg LTD, OUR PARTNERS, DIRECTORS, OFFICIAL PERSONS, OFFICERS, DUTIES, REPRESENTATIVES, EXECUTORS, SERVICE PROVIDERS OR LICENSORS OR THESE SHOPIFY AND THE DAUGHTERSHIPS OF SHOPIFY, WILL NOT BEAR RESPONSIBILITY FOR TRAUMS, LOSSES, PRETENTIONS OR DIRECT, HORSED, ACCOMPANYING, SPECIAL, PRODUCING, CRIMINAL OR EXAMPLE DAMAGES OF ANY TYPE, INCLUDING BUT NOT limited to, DISAPPEARED BENEFITS, DISAPPEARED REVENUE, DISAPPEARED OPERATIONS, DATA LOSS, REPLACEMENT COSTS OR LIKE DAMAGES, INDEPENDENTLY DUTIES ARE BASED ON CONTRACTS, INDEPENDENDIENT PRODUCED FROM YOUR USE OF THE SERVICES OR PRODUCTS ACCRUED BY USING THE SERVICES, OR FOR OTHER PRETENTIONS AS RELATING TO YOUR USE OF THE SERVICES OR OF ANY PRODUCT INCLUDING BUT NOT ONLY, ERROR OR PROCEEDINGS IN CONTAINING A RESULT OF USE OF THE SERVICES OR CONTENT (OR PRODUCT), PUBLISHED, TRANSMITTED OR OTHER WAY PROVIDED THROUGH THE SERVICES, EVEN IF YOU HAVE BEEN NOTIFIED OF THEM. 

SECTION 18 INDEMNIFICATION
You agree to indemnify, defend and hold harmless MasterFishing.bg Fishing Shop, Shopify and our respective affiliates, partners, employees, directors, employees, representatives, contractors, licensors and service providers from any loss, damage, liability or claim, including reasonable attorneys' fees, owed to any third party due to or arising from (1) breach by you of these Terms and Conditions or the documents they include by reference; (2) breach by you of any law or third party rights; (3) your access to and use of the Services.
We will notify you of any indemnified claim, provided that your failure to notify you in due time does not relieve you of your obligations, unless you have suffered material damage. We may control the defense and settlement of such claim at your expense, including the choice of counsel, but we will not settle without your consent (which cannot be unreasonably denied) claims requiring non-monetary obligations on your part. You will assist in the defense of the indemnified claims, including by providing the relevant documents.

SECTION 19 SEVERABILITY
In the event that any provision of these Terms and Conditions is determined by unlawful, void or unenforceable, such provision will nevertheless be applicable to the fullest extent permitted by applicable law, and the unenforceable portion will be deemed separate from these Terms and Conditions and such determination will not affect the validity and enforceability of the remaining provisions.

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of any such right or provision.

These General Terms and Conditions and all separate agreements by which we provide the Services to you shall be governed and interpreted in accordance with the courts in the jurisdiction where MasterFishing.bg is headquartered. You and MasterFishing.bg Fishing shop accept the competent court and personal jurisdiction in these courts.

SECTION 27 – USE OF ARTIFICIAL INTELLIGENCE SYSTEMS
We can provide AI assistant and use AI- assisted processes in content preparation and customer service. When interacting directly, the user is clearly notified that he is communicating with an automated system, not a person. Responses and product recommendations are indicative in nature, may contain inaccuracies and do not constitute a binding offer, acceptance of an order or a guarantee of price, availability, compatibility or result. Current product pages, order finalization information, order confirmation, these Terms and Conditions and manufacturer's instructions take precedence. The user may request assistance from an employee. The processing of personal data is carried out in accordance with the Privacy Policy and The Policy on the Use of Artificial Intelligence (AI).
